Engaged to provide senior commercial management, contract administration, and claims advisory services on Australia's largest renewable energy project. The role involved entitlement management across complex delivery interfaces and multiple project stages supporting the expansion of the Snowy Mountains Hydro-electric Scheme.
Exhibit 02 — Renewable Energy

Appointed by the OEM/EPC Contractor to evaluate and interpret the EPC Contract, with the contractor's liability approaching the contractual cap for liquidated damages. The role involved detailed analysis of LD calculation mechanisms — based on projected versus actual energy generation — and development of strategies to dispute liability by identifying technical and network constraints that limited electricity output during the commissioning phase.

Responsible for commercial strategy and head contract claim submissions arising from COVID-19 impacts, including extensions of time, delay and prolongation costs, and acceleration claims. The engagement involved strategising favourable terms for acceleration directions, managing back-to-back subcontractor entitlements, and supporting the leadership team through to settlement.

Engaged by the OEM/EPC Contractor to lead commercial management on a project complicated by a poorly drafted BOP subcontract and significant subcontractor underperformance. The role required daily strategy development with senior management and legal counsel to address delay, variation, acceleration, and breach of contract issues while mitigating the contractor's exposure to liquidated damages.

Engaged during the project start-up phase to develop commercial policies and procedures, including procurement framework selection. The role also involved reviewing and amending head contract and subcontract terms to ensure back-to-back commercial alignment and mitigation of key contractual risks.

Appointed alongside the Coopers Gap engagement to evaluate the EPC Contract and develop strategies to limit exposure to liquidated damages related to commissioning delays. Engaged by the Main Contractor to lead the commercial team for tunnelling, substation, and airport tunnel upgrades on the T8 line. Responsibilities included procurement and subcontractor management, identification and preparation of head contract claims, and oversight of contract administration including variations, extension of time claims, and subcontractor agreements.

Engaged by the Main Contractor to lead the subcontract commercial team on a major mixed-use development comprising a two-storey retail centre above basement parking and four residential buildings. The role encompassed head contract variation management, value engineering, procurement of key subcontract packages, and day-to-day commercial oversight across all trades.

Managed the commercial functions across five water treatment plant projects in Southwest Western Australia and the Pilbara, delivered under a target cost model with pain/gain share mechanisms. The role included preparation of target cost estimates for additionally awarded projects and contribution to a national initiative to implement improved cost management systems and commercial reporting frameworks.

Appointed as Commercial Manager with full responsibility for commercial functions on a major wastewater infrastructure project delivered under an NEC4 Option C target cost framework. The engagement involved addressing significant cost overruns through a comprehensive financial review, realignment of the project budget, and management of complex compensation events across both subcontracted and self-perform work packages.

The role involved detailed cost analysis across project records, collaboration with delivery teams to establish cause-and-effect linkages, and preparation of claim estimates to support commercial settlement negotiations.

Appointed alongside the Cox River Road engagement to assess the contractor's commercial entitlements and identify unclaimed variations and delay claims. Involved detailed review of project costs despite significant gaps in contemporaneous records, with a targeted approach to prioritise high-value recovery items for commercial settlement discussions.

Engaged by the developer to provide commercial and contractual advisory services in response to significant delays and underperformance by the main contractor. The role included developing strategies for potential termination, step-in rights, and scope reallocation, drafting contractual notices under strict procedural requirements, and conducting scenario analyses to support informed decision-making while balancing risk mitigation with project continuity.

Engaged by a specialist marine subcontractor during the pre-contract phase to negotiate subcontract terms with the head contractor. The role involved reviewing proposed conditions, conducting risk assessments in collaboration with the delivery team, and negotiating directly with the head contractor's legal counsel and senior management to secure favourable contractual positions, including modifications to key risk allocation clauses and adjustments to the contract sum to reflect revised construction methodologies.
